Conditions:

  1. I/We warrant that the information given on the form “Registration as User of ID Africa / Identipet Products”  is true and correct.
  2. I/We am/are aware of the fact that the terms of payment are strictly cash.
  3. Authorised User shall obtain ID Africa / Identipet products for prescribed use only.  Such products may not be resold except as an implant for animal identification purposes.
  4. ID Africa / Identipet retains the intellectual copyright in the information contained on the microchip.  User undertakes not to disclose such information to third parties other than the animal owner without the express written permission of ID Africa / Identipet.
  5. Appointment of User shall be for an indefinite period, terminable by either party on three month’s notice.  Notwithstanding the foregoing, ID Africa / Identipet may terminate User’s appointment where user commits any material breach of his obligations hereunder.
  6. ID Africa / Identipet guarantees all products supplied against defects in materials and workmanship for a period of one year from date of delivery.  ID Africa / Identipet’s sole liability in respect of such guarantees shall be to replace or repair (at it’s sole discretion) any defective product returned to it.  ID Africa / Identipet shall have no liability in respect of death, damage or injury to any animal occasioned through the implant or any device supplied to it, unless such death, damage or injury can be shown to have been caused through ID Africa / Identipet’s gross negligence or willful act.
  7. I/We consent to the jurisdiction of the magistrate’s Court, in respect of all actions arising out of the supply of goods and services, and which would otherwise be behind the jurisdiction of the Magistrate’s Court, such consent as envisaged by Section 45 of the Magistrates Court Act, 1944 (as amended).
  8. Anyone purchasing microchips, having completed an application as "Registration as User of Identipet / ID Africa Products" and having been issued with an ID Africa / Identipet Vet Pin Number and who wishes to implant for his own use, confirms that he has sufficient knowledge / instruction / experience to implant microchips or has sought such veterinary advice and instruction which shall enable him to competently perform the procedure.
  9. I/We agree that the address given shall be my/our domicilium citandi et executandi for all purposes under this agreement, whether in respect of court processes, notices or other documents or communications, of what so ever nature.
  10. I/We hereby acknowledge and agree that ownership of goods purchased will remain the property of ID Africa / Identipet until full and final payment has been made, however I/We agree that all risk in the goods shall pass to me/us on delivery to me/us or my/our agent.
  11. I/We undertake, in the event of the business being sold or there being a change in the constitution of the business, to notify ID Africa / Identipet immediately, in writing. Nothing contained in this paragraph shall prohibit ID Africa / Identipet having right to claim any outstanding amount from the subsequent proprietor / partner / owner.
  12. Any amendment, cancellation hereof, novation or variation of these conditions shall be of no force effect unless recorded in writing and signed by the parties hereto.
  13. No indulgence, which ID Africa / Identipet may grant to me/us, shall constitute a waiver of any of the rights of
    ID Africa / Identipet, who shall not thereby be precluded from exercising any rights against me/us which may arise in the past or which might arise in the future.
